What I do if no action being taken on complaint in India ?

If you have filed a complaint in India, but no action is being taken on it, there are several steps you can consider taking to address the situation:

  1. Follow up with the Investigating Officer: Contact the investigating officer assigned to your case and inquire about the progress. Request updates on the status of the investigation and express your concerns regarding the lack of action. Maintain a record of all communication for future reference.
  2. Contact Higher Authorities: If you are dissatisfied with the progress or response from the investigating officer, you can escalate the matter to higher authorities. This can include approaching the Superintendent of Police (SP), Deputy Commissioner of Police (DCP), or other senior officers within the police department. Submit a written complaint explaining the situation and the lack of action taken on your original complaint.
  3. Seek Legal Advice: Consult with a lawyer who specializes in the relevant area of law pertaining to your complaint. They can assess your case, advise you on the available legal remedies, and guide you on the appropriate course of action. They may suggest filing a writ petition or seeking judicial intervention if necessary.
  4. File a Complaint with the Magistrate or Court: If the police are not taking appropriate action, you can approach the magistrate or court with a private complaint under Section 156(3) of the Code of Criminal Procedure (CrPC). This allows you to seek the court’s direction to the police to investigate your complaint. Consult with a lawyer to understand the specific procedures and requirements for filing a private complaint.
  5. Approach Human Rights Commission or Ombudsman: Depending on the nature of your complaint, you may consider reaching out to the appropriate Human Rights Commission or Ombudsman for assistance. They can investigate complaints of human rights violations or maladministration and take appropriate action.
  6. Raise Awareness and Seek Support: If your complaint involves a matter of public interest or widespread concern, consider raising awareness through social media, the press, or non-governmental organizations (NGOs). Generating public support and attention may put pressure on authorities to take action.

It is crucial to consult with a legal professional who can provide guidance specific to your case and help you navigate the appropriate legal channels. They will be able to assess the circumstances, provide advice, and take necessary steps to address the lack of action on your complaint.
